One of the first questions homeowners ask when considering a basement project is whether they need planning permission. The answer depends on what you are doing, where you live and the specific rules of your London borough.

When You Typically Do NOT Need Planning Permission

Converting an existing cellar or basement into a habitable room generally does not require planning permission, provided you are not extending the footprint beyond the existing building, not altering the external appearance, the property is not in a conservation area or listed, and your local borough has not removed permitted development rights.

When You DO Need Planning Permission

You will typically need full planning permission if you are creating a new basement where none existed, extending the basement footprint under the garden, in a conservation area, in a listed building, or if the property is a flat.

London Borough Rules

Individual London boroughs have their own policies on basement development. Boroughs with particularly detailed basement policies include the Royal Borough of Kensington and Chelsea, Westminster and Camden. Always check with your specific borough before starting any basement project.

The Party Wall Act

Even if you do not need planning permission, basement construction almost always triggers the Party Wall etc. Act 1996 if your property shares a wall with a neighbour. You must serve notice on affected neighbours before starting work.

Building Regulations

Regardless of whether planning permission is required, basement conversions must comply with Building Regulations covering structural stability, fire safety, ventilation, damp proofing, electrical installations and drainage.
